The complainant requested copies of the legal advice received by Gloucestershire County Council relating to badger culling. The council refused to provide the information using section 42(1) of the Freedom of Information Act 2000. This exemption concerns Legal Professional Privilege. The Commissioner’s decision is that the information should have been considered under the Environmental Information Regulations 2004. However, he was satisfied that the information could be withheld under regulation 12(5)(b). This exception also concerns Legal Professional Privilege. The Commissioner does not require any steps to be taken.
