Fegan v Police Service of Northern Ireland: CANI 10 May 2010

Whether the Police Service of Northern Ireland owed a duty of care to the appellant, a social worker employed in a children’s home run by a religious order, when informing the appellant’s employers that following an investigation into allegations of sexual abuse, he was not, in the police view, a fit person to continue to be employed as a social worker in the home. More particularly the question is whether the trial judge Gillen J was correct in law to accede to the respondents’ application for a direction at the close of the appellant’s case on the basis that the respondents owed the appellant no duty of care when making the impugned statement.
