A request was made for information regarding a review carried out by ERM for the Regional Assembly of the North East. The carrying out of such a review is required by SI 2001/1633. ERM did not respond to this request, stating that it was not a public authority for the purposes of the EIR. However, the Commissioner has found that in respect of this specific request, ERM are a public authority and so should have responded to the request under the Regulations.
