The complainant has requested information relating to attendance by the Secretary of State for Health at ‘Christmas drinks’ on a particular date. DHSC refused to disclose the requested information under section 40(2) FOIA. The Commissioner’s decision is that section 40(2) FOIA was applied incorrectly to the withheld information. The Commissioner requires the public authority to disclose the withheld information DHSC has identified as falling within the scope of the request.
