The complainant has requested Key Stage 1 (KS1) assessment data broken down to school level. The Department for Education (DfE) disclosed the KS1 data at Local Authority level but refused to provide this at school level on the basis of section 36(2)(c) of the FOIA. The Commissioner’s decision is that the DfE has correctly applied the provisions of section 36(2)(c) and that the public interest favours maintaining the exemption.
