The Crown Prosecution Service (CPS) refused to provide the requested information citing section 40(2) (personal information) of the FOIA. The Commissioner’s decision is that the CPS was entitled to rely on section 40(2) of the FOIA to withhold the requested information. The Commissioner requires no steps to be taken as a result of this decision.
