The Council disclosed some information but withheld the names of various individuals in reliance on the exemption at section 40(2) of FOIA (third party personal data). The complainant disputed the Council’s reliance on section 40(2) and asked the Commissioner to investigate whether further relevant information was held. The Commissioner’s decision is that the Council was entitled to rely on section 40(2) in respect of the withheld information. The Commissioner further finds that the Council does not hold any further information relevant to the request. The Commissioner does not require any steps to be taken.
