ICO The complainant has requested information concerning the Home Office’s use of the Regulation of Investigatory Powers Act 2000 (RIPA) when investigating its own staff. The Home Office would neither confirm nor deny (NCND) holding any information, citing the exemptions at sections 31(3) (law enforcement), 23(5) (information supplied by, or relating to, security bodies) and 24(2)(national security). The Commissioner’s decision is that the Home Office was entitled to NCND whether it held the requested information by virtue of section 31(3). No steps are required.

GMP would neither confirm nor deny holding information, citing sections 24(2) (national security) and 31(3) (law enforcement). ICO The complainant requested a copy of the 4 June 2014 independent internal review of the domestic homicide review process of the Home Office Domestic Violence Unit. The Home Office refused the request relying on the section 36(2)(b) FOIA exemption. The Commissioner’s decision is that the section 36(2)(b) exemption is engaged but the public interest in disclosing the review outweighed that in maintaining the exemption so that the exemption had therefore been wrongly applied. The Commissioner requires the public authority to disclose the review to ensure compliance with the legislation.

With regard to the remaining information contained in the correspondence which specifically refers to the nominations of other applicants, the Commissioner is satisfied that the public interest favours maintaining this exemption. In respect of the information concerning Lord Janner, the Commissioner is satisfied that sections 40 and 41 do not provide a basis to redact any information with the exception of a very small amount of information which she is satisfied is exempt from disclosure on the basis of section 40(2). At the time of the request, the authority was overseeing the development of a residential property, which included the painting of communal areas. As part of this process, CityWest commissioned a survey that asked the residents to vote on their preferred colour scheme. The complainant subsequently requested confirmation of which flat occupants in a particular block voted for which colour. CityWest originally refused the request on the grounds that it was ‘confidential’ information, only later citing section 40(2) and 41 of the Freedom of Information Act 2000. The Commissioner has found that section 40(2) is engaged and has therefore not gone on to consider the section 41 exemption. He does, however, consider that the authority breached section 17 of the Act in its handling of the request.

ICO In a four part request, the complainant has requested information about an instance of whistleblowing in 2012. The British Broadcasting Corporation (‘the BBC’) says it does not hold information within the scope of one part and cannot categorially verify that it holds information within the scope of one other part. The BBC says that, under section 40(5)(b)(i) of the FOIA, it not obliged to confirm or deny that it holds the information requested in the remaining two parts because do to do so would reveal the personal data of a third person. The Commissioner’s decision is that: On the balance of probabilities, the BBC does not hold information that falls within the scope of parts 1 and 4 of the request. Under section 40(5)(b)(i), the BBC is correct to neither confirm nor deny it holds the information requested at parts 2 and 3 of the request as to do so would release the personal data of a third person. The Commissioner does not require the BBC to take any steps.

ICO The complainant made a freedom of information request to Wirral Metropolitan Borough Council (‘the Council’) for details of companies that had received a grant from the Council through the ‘Big Fund’. The Council refused the request under the exemptions in section 41 (information provided in confidence) and section 43 (commercial interests). The Commissioner’s decision is that the section 41 and section 43 exemptions are not engaged. The Commissioner requires the public authority to disclose the requested information to the complainant.

ICO The complainant requested information relating to the investigation into an allegation of legal aid fraud. The Ministry of Justice (MoJ) confirmed it held information within the scope of the request but refused to provide it citing sections 40(2) (personal information) and 31(1)(a) and (g) (law enforcement) of the FOIA. The Commissioner’s decision is that the MoJ correctly applied sections 40(2) and 31(1) of the FOIA. She requires no steps to be taken.

ICO The complainant submitted a multi-part request to the Ministry of Justice (MoJ) requesting information relating to a job re-grading exercise. Having initially cited other exemptions, the MoJ revisited the request during the course of the Commissioner’s investigation and cited section 12 of the FOIA (cost of compliance exceeds the appropriate limit). The Commissioner’s decision is that the MoJ correctly applied section 12. However, in failing to provide a response within 20 working days of the request, the MoJ breached section 10 of the FOIA. The Commissioner requires no steps to be taken as a result of this decision.
