ICO The complainant requested information from Babergh District Council relating to Nayland Airfield. The council initially said that the information was exempted under the EIR. During the Commissioner’s investigation, the council clarified that it should have said that the information was not held. The complainant did not accept that this was the case. The Commissioner’s decision is that, on the balance of probabilities, the information was not held. The Commissioner does not require any steps to be taken.
