The Aneurin Bevan Health Board (‘the Health Board’) refused to provide the information by virtue of section 40(2) of the FOIA. The Commissioner-andtrade;s decision is that the Health Board correctly relied on section 40(2) to withhold this information. The Commissioner requires no steps to be taken by the Health Board.
