EAT Transfer of Undertakings – Dismissal
The employees sought compensation from the transferee company after a transfer within the regulations, saying that the transferring company had failed to carry out the necessary consultation with them before the transfer.
Held: The transferree was responsible in law for the acts of the transferring company. It was up to the purchaser to protect itself with appropriate indemnities in the purchase.
