ICO The complainant requested information from Chelmsford City Council regarding the rental of Hylands Park for the V Festival. The council provided some information regarding earlier years however it refused to provide more recent information using the exception under regulation 12(5)(e) of the Environmental Information Regulations 2004 relating to commercial confidences. The Commissioner’s decision is that the council correctly relied on regulation 12(5)(e) and correctly determined that the public interest in maintaining the exception outweighed the public interest in disclosing it in the circumstances of this case. The Commissioner also found a breach of regulation 5(2), 14(2) and 14(3) because of the late response and the council’s failure to consider the request under the EIR. The Commissioner does not require any steps to be taken.
