The Opinion was requested by Mr Leif Levon in relation to whether his patent, EP2068179 was being infringed by the defendant’s ‘Baskerville lamp’. The Opinion concluded that there was no infringement of the patent. Mr Levon requested that the review be set aside on the grounds that the examiner had erred in his interpretation of the claims. The Hearing Officer agreed and set aside the opinion.
