Home Office (Central Government): ICO 17 Jul 2019

The complainant has requested information relating to Security Service files of BBC employees from the Home Office (‘HO’). Initially, the HO would neither confirm nor deny holding any information citing section 23(5)(information supplied by, or relating to bodies dealing with security matters) of the FOIA. During the Commissioner’s investigation the HO revised its position advising that the requested information is not held. The Commissioner’s decision is that, on the civil standard of the balance of probabilities, the HO does not hold the requested information. No steps are required.
