Northern Ireland Ambulance Service Health and Social Care Trust (NIAS) refused to disclose the information, citing the exemption at section 40(2) (Personal information) of the FOIA. It argued that the number of post holders covered by the request was sufficiently low to enable individuals to be identified. The Commissioner’s decision is that section 40(2) was applied correctly. However, she found NIAS breached section 10 of the FOIA by exceeding the statutory time for compliance when responding to the request.
