The two companies and Satellite Services were liable for (i) breach of confidence (ii) infringement of Sky’s database rights (iii) infringement of one of the Sky trade marks, and (iv) passing off. It was conceded in the light of the evidence that the two companies and Satellite Services were each liable for breach of confidence. The companies were already involved in windimng up proceedings.
