The complainant has requested information regarding teachers and furlough. Lancashire County Council (‘the council’) provided some information but stated that other information was not held. The Commissioner’s decision is that, on the balance of probabilities, the council has provided all of the information it held in scope of question 1 of the request. However the Commissioner has decided that the council did not provide an adequate response to parts 2 or 3 of the request. The Commissioner’s decision therefore is that the council breached sections 1 and 10 of the FOIA in its handling of parts 2 and 3 of the request. The Commissioner requires the council to take the following steps to ensure compliance with the legislation: Issue a fresh response to parts 2 and 3 of the request that complies with section 1 of the FOIA. The council must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
