The complainant requested a copy of a risk management plan drawn up by Mid Staffordshire NHS Foundation Trust that took account of the changes taking effect in the lead up to the authority acquiring foundation status. In response, the Trust claimed that it did not hold the plan. The Commissioner considers that there are strong arguments for concluding that such a document may be held. However, the Commissioner has decided that, on the balance of probabilities, the surrounding evidence has pointed in favour of the Trust’s position.
