Department of Trade and Industry (Decision Notice): ICO 31 May 2006

The complainant requested details of a DTI investigation into alleged insider dealing in shares at Anglia Television. The DTI refused this request stating that a statutory prohibition made it a criminal offence to disclose this information without certain conditions being satisfied. The Commissioner contacted the DTI for a further explanation as to the application of the exemption under section 44 of the Act and sought legal advice as to the current validity of the statutory prohibition. It has been determined that the statutory prohibition is still provided for in law and therefore the section 44 exemption is valid. The Information Tribunal has ruled on this decision and has dismissed this appeal.
