Royal Mail (Decision Notice): ICO 9 Nov 2009

The complainant made a request under the Freedom of Information Act 2000 to the Royal Mail for information relating to Post Offices in Norfolk. The Royal Mail refused the complainant’s request as it stated that some of the information requested was exempt from disclosure by virtue of section 43(2) of the Act. The Royal Mail confirmed that the remainder of the information requested was not held under section 1(1)(a) of the Act. The Commissioner has reviewed the withheld information and has decided that section 43(2) was not correctly engaged in this case. The Commissioner considers that the remainder of the requested information is not held under section 1(1)(a) of the Act. Furthermore the Commissioner considers that the Royal Mail breached section 1(1)(b) and section 10(1) in the handling of this request. Information Tribunal appeal EA/2009/0112 withdrawn.
