The defendant indicated at the magistrates’ court that he was ‘likely to plead guilty’ – whether that was sufficient to attract full benefit of early plea indication.
Held: The appeal failed. To receive the full one third credit, pursuant to the Guideline, where it was not procedurally possible at the magistrates’ court for a defendant to enter a guilty plea, there had to be an unequivocal indication of the defendant’s intention to plead guilty
