Regina v Hamilton: CACD 15 Jul 1997

The defendant had been convicted of a domestic burglary. He appealed the sentence of three years. He had been caught nearby after being disturbed, and nothing had been taken.
Held: He had previous convictions for burglary, but the last was more than ten years previous. Nevertheless, three years was too much, and two years was substituted.
