The defendant renewed his application for leave to appeal against sentence for burglary of a restaurant (30 months), but which involved disturbing a resident occupier.
Held: The defendant had a serious record of dishonesty, and this offence took place whilst he was serving community service. The sentence was correct. Leave refused.
