Commonwealth, Intellectual Property
(Supreme Court of British Columbia) The court discussed the test for joint authorship after reviewing authorities in Canada, the US and England and said: "In the result I find that the test for joint authorship that should be applied to the facts in the instant case is as follows:
i) Did the plaintiff contribute significant original expression to the songs? If yes,
ii) Did each of the plaintiff and Ms McLachlan intend that their contributions be merged into a unitary whole? If yes,
iii) Did each of the plaintiff and Ms McLachlan intend the other to be a joint author of the song?" and "the creation of the intent to co-author requirement in Childress v. Taylor happened despite the statutory definition of joint authorship . . . not because of it. The court looked beyond the language of the section and moved on to review policy considerations in the application of the section. In particular, the court could not accept that Congress intended to extend joint authorship to, for example, editors and researchers. It was for this reason that the court created the intent to co-author requirement."

Geoffrey Hobbs QC
Intellectual Property
Geoffrey Hobbs QC said: "On the evidence before me I am prepared to accept that at the date of the application for registration of the later CORGI trade mark: (i) the applicant was the proprietor of a substantial and valuable goodwill built-up and acquired in connection with the promotion and sale of CORGI model vehicles over many years; (ii) the applicant could be damaged in its use and enjoyment of that goodwill if people were deceived or confused by use of the later CORGI trade marks as a trade mark for outer wear, sport and leisure wear. There is a question as to whether the word CORGI has been used by the applicant in a manner and to an extent sufficient to cause it to be misleading when used as a trade mark for the goods of interest to the respondent. This is the point at which I begin to have difficulty with the applicant's objection under section 5(4). I do not regard it as self-evident that people would be misled (with a concomitant risk of damage to the applicant in its use and enjoyment of the goodwill built up and acquired in connection with the promotion and sale of CORGI model vehicles) if the word CORGI was used by the respondent as a trade mark for outer wear, sport and leisure wear. The applicant's evidence leaves me in doubt on these matters. I think it is quite possible that people would perceive or assume correctly that the same mark was being used by separate undertakings trading independently of one another."

Three members of the group Spandau Ballet sought to be treated as joint authors of the songs in which copyright was claimed. The songs had been composed at home by another member of the group who was a keyboard player and singer, but then played and learned by the claimants, who added their own interpretation to the performance. Held: Their contribution as performers was not a sufficient original contribution to the creation of the songs for them to count as joint authors.

The court interpreted the phrase "full particulars of the product or process alleged to infringe" in the context of the disclosure-avoidance provision in the former Order 104 rule 11 as "particulars sufficient to enable all issues of infringement to be resolved. The description must be complete in all relevant areas. A description of the product either in general terms or including tendentious assertions is not acceptable."

Satnam's agents (DH) had passed on confidential information to the claimant's business rival (Morbaine). Armed with this information Morbaine acquired a development site which Satnam had wanted to buy. Held: The court rejected an argument that Morbaine held the site on constructive trust for Satnam. A company purchasing land on strength of unintended and uninvited disclosure of confidential information from a rival for the land did not, simply because of that, hold the land on trust of whatever nature for the owner of the information. Nourse LJ: "Clearly, DH and Mr Murray can be regarded as trustees of the information and, clearly, Morbaine can be regarded as having been a knowing recipient of it. However, even assuming, first, that confidential information can be treated as property for this purpose and, secondly, that but for the disclosure of the information Morbaine would not have acquired the Brewery Street site, we find it impossible, in knowing receipt, to hold that there was a sufficient basis for subjecting the Brewery Street site to the constructive trust for which Satnam contends. The information cannot be traced into the site and there is no other sufficient nexus between the two."

Jurisdiction, Intellectual Property
An English court does not have to refuse an application which sought to apply a foreign copyright law in a claim based on acts committed abroad on the basis that not actionable here. Such restrictions applicable to land actions only: "It is, we think, clear from an analysis of the judgments in the Moçambique case that the House of Lords treated the question whether the English courts should entertain an action for trespass to foreign land as one of justiciability. The English courts should not claim jurisdiction to adjudicate upon matters which, under generally accepted principles of private international law, were the peculiar province and competence of another state…"

A company which was using a competitor's trade mark in the context of an advert, which made misleading and derogatory comparisons, failed the 'honest practice' test, and was abusing the rights to use the other company's mark under the Act. In this case however each party was guilty of such failures.

The past normal practice, after a finding of patent infringement, to grant a wide ranging injunction, needs to be reconsidered, and the Court of Appeal should be asked for guidance. The present practice was capable of producing unfairness.

An action was begun opposing a trade mark. It was conducted under the old rules, which did not allow for an order for discovery. After the new rules came into effect, discovery was sought, but the registrar said the old rules would continue to apply within the case. That decision was now challenged by way of judicial review. Held: The action was pending at the time of the new Act within Schedule 3. Section 78 gave wide powers to make rules, and those were not limited to merely procedural issues. The change in the rules would affect substantive rights, and a statute was not to be applied retrospectively unless it was clearly intended to do so.

The expressions complained of as trade mark infringements were "BMW specialist," "Specialised in BMWs" and "Repairs and maintenance of BMWs". Held: The Court proceeded on the basis that this was an Art.5(1)(a) case of identical marks and goods. It did not explicitly first identify the sign used by the defendant. But it was obvious what it was: just BMW. The other words in context were wholly devoid of any trade mark significance.

There is a public interest defence to an allegation of copyright infringement. A newspaper republished video camera stills to demonstrate the untruth of assertions made publicly about the relationship if Princess Diana and Dodi Fayed. Held: It was a current event, and the fair dealing defence applied.

Intellectual Property, Litigation Practice, Jurisdiction
Documents disclosed in support an application in a costs taxation, remained subject to implied duties of confidence, and they could not be used for any other purpose, including to support litigation abroad. Where questions of US law arose, a US court was the best place to decide those questions. Legal privilege is not lost under English law because it cannot be claimed in another country: "To suggest otherwise would mean that a court, when deciding whether to uphold a claim for privilege, would need to be informed as to whether privilege could be claimed in all the countries of the world. . . The fact that under a foreign law the document is not privileged or that the privilege that existed is deemed to have been waived is irrelevant. The crucial consideration is whether the document and its information remain confidential in the sense that it is not properly available for use. If it is, then privilege in this country can be claimed and that claim, if properly made, will be enforced."

Intellectual Property, European
Registration is to be refused in respect of descriptive marks, ie marks composed exclusively of signs or indications which may serve to designate the characteristics of the categories of goods or services in respect of which registration is applied for. Article 3(1)(c) therefore prevents descriptive signs and indications from being reserved to one undertaking alone because they have been registered as trade marks. A geographical name could not normally be registrable as a trade mark, even where a place was already associated with certain goods, or might become so associated. A name could only be registrable where had come to be associated with a particular product. As to the use of a registered mark by third parties: "In addition, Article 6(1)(b) of the Directive, to which the national court refers in its questions, does not run counter to what has been stated as to the objective of Article 3(1)(c), nor does it have a decisive bearing on the interpretation of that provision. Indeed, Article 6(1)(b), which aims, inter alia, to resolve the problems posed by registration of a mark consisting wholly or partly of a geographical name, does not confer on third parties the right to use the name as a trade mark but merely guarantees their right to use it descriptively, that is to say, as an indication of geographical origin, provided that it is used in accordance with honest practices in industrial and commercial matters."
Council Directive 89/104/EEC art 3

Intellectual Property, Police
The issue was the potential disclosure by the police to the nurses' regulatory body of confidential information concerning the plaintiff, the matron of a nursing home. There had been insufficient evidence to charge the plaintiff with a criminal offence. The regulatory body wished to consider disciplinary proceedings. The plaintiff unsuccessfully sought an injunction to restrain the disclosure. Held: A countervailing public interest prevailed. The police investigating serious allegations were entitled to reveal the results to a professional regulatory body supervising the suspect. Such information is received by the police in confidence, and remains subject to the same limitations. However: "In order to safeguard the interests of the individual, it is . . desirable that, where the police are minded to disclose, they should, as in this case, inform the person affected of what they propose to do in such time as to enable that person, if so advised, to seek assistance from the court. In some cases, that may not be practicable or desirable, but in most cases that seems to . . be the course that should be followed." and "In my view, the guiding principles from the exercise of the power to disclose . . are those ennunciated in ex parte Thorpe. Each of the Respondent authorities had to consider the case on its own facts. A blanket approach was impermissible. Having regard to the sensitivity of the issues raised by the allegations of sexual impropriety made against LM, disclosure should only be made if there is a 'pressing need'. Disclosure should be the exception and not the rule. That is because the consequences of disclosure of such information for the subject of the allegations can be very damaging indeed. The facts of this case show that disclosure can lead to loss of employment and social ostracism, if not worse. Disclosure should, therefore, only be made if there is a pressing need for it."

The court was asked if the section 92(5) defence applied where the defendant does not know of the existence of the registered trade mark in question. Held: The defence is not available in such a case. The court noted that section 92(5) speaks of a reasonable belief that the 'manner' of use of the sign did not infringe 'the registered trade mark'. This presupposed an awareness by the defendant of the existence of the registration against which he can match his manner of use of the allegedly infringing sign. The test of whether a Trade Mark offence has been committed by a trader selling goods is whether or not the infringing goods have been offered for sale, and does not depend upon any test of whether the trader was aware of the infringement or whether he had been diligent in finding an answer. The defence related only to whether the manner of use of the mark was reasonable.

The public policy defence of a right to repair by creation of 'spare parts' to a copyright infringement claim depended upon the right being so clear that no right thinking person would quarrel with it. An equitable duty of confidence falls on a recipient of information where any reasonable person would see the receipt in these terms.

ECJ

European, Intellectual Property
ECJ In accordance with the division of functions provided for by Article 177 of the Treaty (now Article 234 EC), the role of the Court of Justice is limited to providing the national court with the guidance on interpretation necessary to resolve the case before it, while it is for the national court to apply the rules of Community law, as interpreted by the Court, to the facts of the case under consideration.
It is possible that mere aural similarity between a trade mark and a sign, used for identical or similar products, may create a likelihood of confusion within the meaning of Article 5(1)(b) of First Directive 89/104 on trade marks. The more similar the goods or services covered and the more distinctive the earlier mark, the greater will be the likelihood of confusion.
In order to determine the distinctive character of a mark and, accordingly, to assess whether it is highly distinctive, it is necessary to make a global assessment of the greater or lesser capacity of the mark to identify the goods or services for which it has been registered as coming from a particular undertaking, and thus to distinguish those goods or services from those of other undertakings. In making that assessment, account should be taken of all relevant factors and, in particular, of the inherent characteristics of the mark, including the fact that it does or does not contain an element descriptive of the goods or services for which it has been registered. It is not possible to state in general terms, for example by referring to given percentages relating to the degree of recognition attained by the mark within the relevant section of the public, when a mark has a strong distinctive character.

The pursuer developed and patented a brake fluid safety device. They obtained an interest free loan, and as security assigned the patent and any future developments. After the enforcement of the debt, the lenders sold the assignment to the defenders who made improvements which they patented. The pursuer claimed that those improvements infringed the patent.

European, Intellectual Property
ECJ 1 Under Article 4 of Regulation No 40/94 on the Community trade mark, the decisive factor if a sign capable of being represented graphically is to be eligible for registration as a Community trade mark is its capacity to distinguish the goods of one undertaking from those of another. Consequently, the distinctive character of a sign can be assessed only in relation to the goods or services in respect of which its registration is applied for.
2 Under Article 7(1)(c)of Regulation No 40/94 on the Community trade mark, `trade marks which consist exclusively of signs or indications which may serve, in trade, to designate the kind, quality, quantity, intended purpose, value, geographical origin or the time of production of the goods or of rendering of the service, or other characteristics of the goods or service' are not to be registered. It was thus the intention of the legislature that such signs should, by their very nature, be regarded as incapable of distinguishing the goods of one undertaking from those of another. The sign `BABY-DRY' - registration of which was sought in respect of `disposable diapers made out of paper or cellulose' and `diapers made out of textile' - is not capable of constituting a Community trade mark, being composed exclusively of words which may serve in trade to designate the intended purpose of the goods.
3 The Office for Harmonisation in the Internal Market (Trade Marks and Designs)was established by Regulation No 40/94 to register Community trade marks which, being valid throughout the territory of the Member States, are an important instrument for the completion of the internal market. The Boards of Appeal, which form part of the Office, also contribute, within the limits set by the regulation, to the application of that instrument. In that sense, there is continuity in terms of their functions between the Boards of Appeal and the examiner whose responsibility it is to take the decisions concerning applications for registration.
It is clear from the scheme of Regulation No 40/94, as well as from Articles 61(2) and 62(1) thereof - concerning the examination of the appeal and the ensuing decision - that it is not open to a Board of Appeal, which enjoys the same powers in determining an appeal as the examiner, simply to reject an applicant's arguments solely on the ground that they were not raised before the examiner. After considering an appeal, the Board should either rule on the substance of the issue or remit the matter to the examiner.
4 In proceedings contesting a decision of one of the Boards of Appeal of the Office for Harmonisation in the Internal Market (Trade Marks and Designs)refusing an application for registration of a trade mark on one of the absolute grounds for refusal set out in Article 7(1)(b), (c)or (d)of Regulation No 40/94, it is not for the Court to determine an application pursuant to Article 7(3)of the Regulation - seeking to establish that a mark has become distinctive in consequence of the use made of it - where the merits of that claim have not been considered by the Office.
5 Where an action is brought before the Community judicature contesting a decision of one of the Boards of Appeal of the Office for Harmonisation in the Internal Market (Trade Marks and Designs), the Office is required under Article 63(6)of Regulation No 40/94 to take the measures necessary to comply with the judgment of the Court of Justice. Accordingly, the Court of First Instance is not entitled to issue directions to the Office.

Intellectual Property
There is no rule requiring a court always to give fullest relief to parties in intellectual property cases. Where infringement of copyright by the sale of counterfeit software was found to be inadvertent or unintended, the judge could properly restrict the injunctive relief awarded, and an undertaking from the defendant was accepted.

LLoyd J
Intellectual Property
An application to register a shape as a trade mark, on the basis of the shape only and without association with any other indication, would fail unless some particular element of the shape was driven by more than the need to produce a technical effect. Where an association with a particular shape with the applicant arising from long use was to be used found the claim, full evidence would be required. When application was made to register the shape of an electric toaster as a trade mark, LLoyud J said that he should ask: "does [the mark] have a meaning denoting the origin of the goods?"

The Board of Appeal, hearing an appeal from an examiner's decision on a trade mark application, need not restrict itself to hearing issues raised before the examiner. The close continuity of function between the two offices, was demonstrated by their rules. The Appeal Board could exercise any function exercisable by the examiner, and so could hear new issues.

Intellectual Property, Civil Procedure Rules
A court hearing an appeal under the Act, and deciding whether or not to admit new evidence, must now bear in mind the overriding objectives of litigation as defined, and also the need for proportionality. In this case, the pre-hearing procedures had failed to identify the real issues between the parties, and justice required that additional evidence be admitted rather than the case be remitted for hearing.

European, Intellectual Property
It was proper for a national patents system to require that before any patent was lodged with that nation's patents registrar, any European Patent granted should become deemed void ab initio unless it was translated into the national language of that state. A requirement to do so within three months of being lodged was not infringement of the free movement of goods.

An unincorporated association has standing to pursue an action for passing off through an action brought by one or more of its members in a representative capacity despite its not being a natural legal person. A local association having held a trade fair for many years under a certain name could prevent a former member using the same name for a fair after leaving the association.

Mere confusion of identity was insufficient to establish the tort of passing off. The tort is not dependent upon intention. A claimant must establish that it has a goodwill capable of being damaged, that the confusion caused was such as to amount to a misrepresentation of some connection between the two companies, and that the misrepresentation had or was likely to damage the goodwill of the claimant.

Intellectual Property
The originator of 'Bach Flower Remedies' had distributed them widely, and encouraged the use of the term as a general descriptive remedies. After the plaintiff had registered the names as trade marks, the respondent challenged the registration, and it was found that the names had come to be understood as generic names for the remedies, were not capable of distinguishing the goods of one concern from another's, and the registration must fail.

Insolvency, Litigation Practice, Intellectual Property
The rule which prevents a company in administration being prosecuted without the leave of the court, was not intended only to restrict creditors. Here another company wanted to bring patent infringement proceedings, but were first to be required to obtain the court's consent.

Arklow Investments Ltd and Another -v- I D Maclean and Others (Appeal No 17 of 1999); [1999] UKPC 51; [2000] 1 WLR 594
1 Dec 1999
PC
Lord Steyn, Lord Lloyd of Berwick, Lord Hobhouse of Woodborough, Sir Andrew Leggatt, Mr. Justice Henry
Commonwealth, Intellectual Property, Equity, Banking
PC (New Zealand) Land was offered for sale. A potential buyer, the appellant was approached by a merchant bank with a proposal for finance. When he sought finance elsewhere, a company associated with the bank bought the land instead. The appellant complained that the information acquired by the bank on his behalf was confidential to him, and that the bank had acted in breach of its duty of confidence to him. He also claimed a breach of a duty of loyalty. Held: A duty of loyalty arises when a relationship gives rise to a legitimate expectation, which equity will recognise, that the fiduciary will not utilise his or her position in a way which is adverse to the interests of the principal. The court was unable to see an evidential basis for finding that a relationship of trust and confidence, in this sense of undertaking an obligation of loyalty, arose in this case. The claimant did not accept the proposal, and so no relationship arose. Characterising the duty to respect confidential information as fiduciary does not create particular duties of loyalty which are imposed as a result of the nature of the particular relationship and the circumstances giving rise to it. It is not the label which defines the duty. Though the defendant had acquired confidential information there was insufficient evidence that that information had been misused, or that the claimant had suffered any loss as a result directly of such use. Some of the information for which confidence was claimed was not capable of being confidential.

Sprints Ltd -v- Comptroller of Customs and Chipie Design and Signoles S A (Mauritius) [1999] UKPC 57; (Appeal No 45 of 1998)
16 Dec 1999
PC
Lord Slynn of Hadley, Lord Mackay of Clashfern, Lord Jauncey of Tullichettle, Lord Hope of Craighead, Lord Clyde
Intellectual Property, Commonwealth
(Mauritius) The claimant sought registration in Mauritius of a trade mark for the applicants which had been registered in the respondents name in several jurisdictions over the world. Mauritian law provided that an application for registration may be made by any person who has a right to use a trade mark, but also prohibited registration of marks where the use "would by reason of its being calculated to deceive or otherwise" be disentitled to protection in a court. The objectors had marked goods for export to Mauritius. Held: The marking of goods with the intention of exporting them to Mauritius was enough to constitute use of the mark there. The words "disentitled to protection in a court of justice", required not only a likelihood of deception or confusion but also a user at the relevant time by the owner of the mark which the court would protect. There was no effective distinction just because the word might be a domestic one.
