ÂPasterfield -v- Denham [1999] FSR 168 1999 ChD HH Judge Overend Intellectual Property Distortion or mutilation is only actionable under the section if it is prejudicial to the author's honour or reputation. Copyright Designs and Patents Act 1988 80 1 Citers  Darryl Neudorf -v- Network Expressions [1999] RPC 935 1999 Cohen J Commonwealth, Intellectual Property (Supreme Court of British Columbia) The court discussed the test for joint authorship after reviewing authorities in Canada, the US and England and said: "In the result I find that the test for joint authorship that should be applied to the facts in the instant case is as follows: i) Did the plaintiff contribute significant original expression to the songs? If yes, ii) Did each of the plaintiff and Ms McLachlan intend that their contributions be merged into a unitary whole? If yes, iii) Did each of the plaintiff and Ms McLachlan intend the other to be a joint author of the song?" and "the creation of the intent to co-author requirement in Childress v. Taylor happened despite the statutory definition of joint authorship . . . not because of it. The court looked beyond the language of the section and moved on to review policy considerations in the application of the section. In particular, the court could not accept that Congress intended to extend joint authorship to, for example, editors and researchers. It was for this reason that the court created the intent to co-author requirement." 1 Citers  In re Corgi [1999] RPC 15 1999 Geoffrey Hobbs QC Intellectual Property Geoffrey Hobbs QC said: "On the evidence before me I am prepared to accept that at the date of the application for registration of the later CORGI trade mark: (i) the applicant was the proprietor of a substantial and valuable goodwill built-up and acquired in connection with the promotion and sale of CORGI model vehicles over many years; (ii) the applicant could be damaged in its use and enjoyment of that goodwill if people were deceived or confused by use of the later CORGI trade marks as a trade mark for outer wear, sport and leisure wear. There is a question as to whether the word CORGI has been used by the applicant in a manner and to an extent sufficient to cause it to be misleading when used as a trade mark for the goods of interest to the respondent. This is the point at which I begin to have difficulty with the applicant's objection under section 5(4). I do not regard it as self-evident that people would be misled (with a concomitant risk of damage to the applicant in its use and enjoyment of the goodwill built up and acquired in connection with the promotion and sale of CORGI model vehicles) if the word CORGI was used by the respondent as a trade mark for outer wear, sport and leisure wear. The applicant's evidence leaves me in doubt on these matters. The songs had been composed at home by another member of the group who was a keyboard player and singer, but then played and learned by the claimants, who added their own interpretation to the performance. Armed with this information Morbaine acquired a development site which Satnam had wanted to buy. Held: The court rejected an argument that Morbaine held the site on constructive trust for Satnam. A company purchasing land on strength of unintended and uninvited disclosure of confidential information from a rival for the land did not, simply because of that, hold the land on trust of whatever nature for the owner of the information. Nourse LJ: "Clearly, DH and Mr Murray can be regarded as trustees of the information and, clearly, Morbaine can be regarded as having been a knowing recipient of it. However, even assuming, first, that confidential information can be treated as property for this purpose and, secondly, that but for the disclosure of the information Morbaine would not have acquired the Brewery Street site, we find it impossible, in knowing receipt, to hold that there was a sufficient basis for subjecting the Brewery Street site to the constructive trust for which Satnam contends. The plaintiff unsuccessfully sought an injunction to restrain the disclosure. Held: A countervailing public interest prevailed. The police investigating serious allegations were entitled to reveal the results to a professional regulatory body supervising the suspect. Such information is received by the police in confidence, and remains subject to the same limitations. However: "In order to safeguard the interests of the individual, it is . . desirable that, where the police are minded to disclose, they should, as in this case, inform the person affected of what they propose to do in such time as to enable that person, if so advised, to seek assistance from the court. In some cases, that may not be practicable or desirable, but in most cases that seems to . . be the course that should be followed." and "In my view, the guiding principles from the exercise of the power to disclose . . are those ennunciated in ex parte Thorpe. Each of the Respondent authorities had to consider the case on its own facts. A blanket approach was impermissible. Having regard to the sensitivity of the issues raised by the allegations of sexual impropriety made against LM, disclosure should only be made if there is a 'pressing need'. Disclosure should be the exception and not the rule. That is because the consequences of disclosure of such information for the subject of the allegations can be very damaging indeed. The facts of this case show that disclosure can lead to loss of employment and social ostracism, if not worse. Held: The defence is not available in such a case. The court noted that section 92(5) speaks of a reasonable belief that the 'manner' of use of the sign did not infringe 'the registered trade mark'. This presupposed an awareness by the defendant of the existence of the registration against which he can match his manner of use of the allegedly infringing sign. The test of whether a Trade Mark offence has been committed by a trader selling goods is whether or not the infringing goods have been offered for sale, and does not depend upon any test of whether the trader was aware of the infringement or whether he had been diligent in finding an answer. The defence related only to whether the manner of use of the mark was reasonable. It is possible that mere aural similarity between a trade mark and a sign, used for identical or similar products, may create a likelihood of confusion within the meaning of Article 5(1)(b) of First Directive 89/104 on trade marks. The more similar the goods or services covered and the more distinctive the earlier mark, the greater will be the likelihood of confusion. In order to determine the distinctive character of a mark and, accordingly, to assess whether it is highly distinctive, it is necessary to make a global assessment of the greater or lesser capacity of the mark to identify the goods or services for which it has been registered as coming from a particular undertaking, and thus to distinguish those goods or services from those of other undertakings. In making that assessment, account should be taken of all relevant factors and, in particular, of the inherent characteristics of the mark, including the fact that it does or does not contain an element descriptive of the goods or services for which it has been registered. Consequently, the distinctive character of a sign can be assessed only in relation to the goods or services in respect of which its registration is applied for. 2 Under Article 7(1)(c)of Regulation No 40/94 on the Community trade mark, `trade marks which consist exclusively of signs or indications which may serve, in trade, to designate the kind, quality, quantity, intended purpose, value, geographical origin or the time of production of the goods or of rendering of the service, or other characteristics of the goods or service' are not to be registered. It was thus the intention of the legislature that such signs should, by their very nature, be regarded as incapable of distinguishing the goods of one undertaking from those of another. The sign `BABY-DRY' - registration of which was sought in respect of `disposable diapers made out of paper or cellulose' and `diapers made out of textile' - is not capable of constituting a Community trade mark, being composed exclusively of words which may serve in trade to designate the intended purpose of the goods. 3 The Office for Harmonisation in the Internal Market (Trade Marks and Designs)was established by Regulation No 40/94 to register Community trade marks which, being valid throughout the territory of the Member States, are an important instrument for the completion of the internal market. The Boards of Appeal, which form part of the Office, also contribute, within the limits set by the regulation, to the application of that instrument. In that sense, there is continuity in terms of their functions between the Boards of Appeal and the examiner whose responsibility it is to take the decisions concerning applications for registration. It is clear from the scheme of Regulation No 40/94, as well as from Articles 61(2) and 62(1) thereof - concerning the examination of the appeal and the ensuing decision - that it is not open to a Board of Appeal, which enjoys the same powers in determining an appeal as the examiner, simply to reject an applicant's arguments solely on the ground that they were not raised before the examiner. After considering an appeal, the Board should either rule on the substance of the issue or remit the matter to the examiner. 4 In proceedings contesting a decision of one of the Boards of Appeal of the Office for Harmonisation in the Internal Market (Trade Marks and Designs)refusing an application for registration of a trade mark on one of the absolute grounds for refusal set out in Article 7(1)(b), (c)or (d)of Regulation No 40/94, it is not for the Court to determine an application pursuant to Article 7(3)of the Regulation - seeking to establish that a mark has become distinctive in consequence of the use made of it - where the merits of that claim have not been considered by the Office. 5 Where an action is brought before the Community judicature contesting a decision of one of the Boards of Appeal of the Office for Harmonisation in the Internal Market (Trade Marks and Designs), the Office is required under Article 63(6)of Regulation No 40/94 to take the measures necessary to comply with the judgment of the Court of Justice. A potential buyer, the appellant was approached by a merchant bank with a proposal for finance. When he sought finance elsewhere, a company associated with the bank bought the land instead. The appellant complained that the information acquired by the bank on his behalf was confidential to him, and that the bank had acted in breach of its duty of confidence to him. He also claimed a breach of a duty of loyalty. Held: A duty of loyalty arises when a relationship gives rise to a legitimate expectation, which equity will recognise, that the fiduciary will not utilise his or her position in a way which is adverse to the interests of the principal. The court was unable to see an evidential basis for finding that a relationship of trust and confidence, in this sense of undertaking an obligation of loyalty, arose in this case. The claimant did not accept the proposal, and so no relationship arose. Characterising the duty to respect confidential information as fiduciary does not create particular duties of loyalty which are imposed as a result of the nature of the particular relationship and the circumstances giving rise to it. It is not the label which defines the duty. Though the defendant had acquired confidential information there was insufficient evidence that that information had been misused, or that the claimant had suffered any loss as a result directly of such use. Mauritian law provided that an application for registration may be made by any person who has a right to use a trade mark, but also prohibited registration of marks where the use "would by reason of its being calculated to deceive or otherwise" be disentitled to protection in a court. The objectors had marked goods for export to Mauritius. Held: The marking of goods with the intention of exporting them to Mauritius was enough to constitute use of the mark there. The words "disentitled to protection in a court of justice", required not only a likelihood of deception or confusion but also a user at the relevant time by the owner of the mark which the court would protect. There was no effective distinction just because the word might be a domestic one.
