The claimant sold its goods via the internet. Part of the trade was to sell advertising space on its web pages. The claimant had registered the mark 'avnet' for advertising and promotional services. The defendant was an ISP providing internet services, particularly to the aviation industry, which included allowing advertising on its web pages. Held: The parties were in different areas of trade, and there was no infringement. The court considered the general principles as to the construction of a specification of services in a trade mark registration: "specifications for services should be scrutinised carefully and they should not be given a wide construction covering a vast range of activities. They should be confined to the substance, as it were, the core of the possible meanings attributable to the rather general phrase."

The court set out the applicable legal principles in trade mark infringement. The court considered the elements necessary to establish a defence under s10(6): The primary objective of section 10(6) of the 1996 Act is to permit comparative advertising . . As long as the use of a competitor's mark is honest, there is nothing wrong in telling the public of the relative merits of competing goods or services and using registered trade marks to identify them . . The onus is on the registered proprietor to show that the factors indicated in the proviso to section 10(6) exist . . There will be no trade mark infringement unless the use of the registered mark is not in accordance with honest practices . . The test is objective: would a reasonable reader be likely to say, upon being given the full facts, that the advertisement is not honest? . . Statutory or industry agreed codes of conduct are not a helpful guide as whether an advertisement is honest for the purposes of section 10(6). Honesty has to be gauged against what is reasonably to be expected by the relevant public of advertisements for the goods or services in issue . . It should be borne in mind that the general public are used to the ways of advertisers and expect hyperbole . . The 1994 Act does not impose on the courts an obligation to try and enforce through the back door of trade mark legislation a more puritanical standard than the general public would expect from advertising copy . . An advertisement which is significantly misleading is not honest for the purposes of section 10(6). . I venture with diffidence to make a number of additional observations. The advertisement must be considered as a whole . . As a purpose of the 1994 Act is positively to permit comparative advertising, the court should not hold words used in the advertisement to be seriously misleading for interlocutory purposes unless on a fair reading of them in their context and against the background of the advertisement as a whole they can really be said to justify that description; A minute textual examination is not something upon which the reasonable reader of an advertisement would embark;
The court should therefore not encourage a microscopic approach to the construction of a comparative advertisement on a motion for interlocutory relief."

(Federal Court of Australia) What makes up the copyright work is in any given case is not governed by what the claimant alleging copyright infringement chooses to say that it is. It is rather a matter for objective determination by the court.

These developments showed that the basic value protected by the law in such cases was privacy. There was no continuing requirement to show a pre-existing relationship of confidence.

In a threat action for trade mark infringement, the plaintiff had only supplied services. The defendant made a general threat without limiting it to proceedings in respect of goods or services. The defendant argued that the threat would be understood as relating only to services, as that is all the plaintiff provided. Held: Section 70 provides a new remedy of a declaration, the grant of which is always discretionary. It may be refused if the application is frivolous, unnecessary, futile, oppressive or otherwise objectionable. In a case where a declaration is granted under Section 21, the Court may decline to grant a wider declaration under the inherent jurisdiction on grounds that it is unnecessary or undesirable. Neuberger J applied the same approach to determining whether a threat of proceedings has been made as was applied in relation to the threats provision in the Patents Act 1977.
The threat was entirely general and there was no basis for saying that it fell within the exception. Neuberger J said: "in the end I consider that the language in section 21(1), when read as a whole, is clear . . I consider that one takes the communication, and decides whether it would be understood by a reasonable person in the position of the recipient to be a threat of infringement proceedings. If it is such a threat, then one must decide whether, on its face, the communication nonetheless is outside section 21(1), because it falls within one of the three excepting paragraphs.
Although at first sight this may not appear to comply with the philosophy behind section 21(1), I believe that, on analysis, it does. The section is concerned to ensure that threats of infringement proceedings are not made casually or recklessly, because of the potential damage and concern they can cause. Anyone who wishes to write a letter raising the possibility of infringement proceedings is, therefore, required to consider with care whether he has any case, and, if he is to communicate with another, to take care in expressing himself. If, therefore, the person making such communication wishes to take advantage of one or more of the excepting paragraphs of section 21(1), it is incumbent upon him to indicate this in terms."

The opponents opposition was based on their use of the terms PLUS, JUNIOR and SENIOR to differentiate variations of software products and they in fact used the mark CHECKBOOK SENIOR on a modest scale from 1994 up to the date of the applicant’s application in March 1995. They also claimed use of the term by two other software houses but the evidence filed to support such claims was, at best, inconclusive. The applicants claimed their mark SENIOR had been in use from 1986 onwards.
Under Section 3 the Hearing Officer concluded that the mark failed to qualify for registration in the prima facie but taking into account the applicants extensive use he concluded that the mark was distinctive in relation to a range of computer software in Class 9 (and associated goods in Class 16) and that the application could proceed in respect of such goods.
Under Section 5(4)(a) - Passing Off - the Hearing Officer decided that the opponents had failed to present an arguable case under this head and, on the basis of the evidence filed, they failed on this ground. Similarly they failed under Section 6(1)(c) since they had failed to show that SENIOR was a well known mark in the context of their products.

IPO This application was filed on 2 November, 1995. In their evidence the opponents stated that the 07000 series of telephone numbers had been allocated to one of their subsidiary companies on 2 February 1995 for their exclusive use. The allocation was confirmed by OFTEL on 6 November 1995 and the service was launched in December 1995. The applicants neither filed a counterstatement nor a response to the opponents evidence.
The Hearing Officer accepted that the opponents wholly owned subsidiary were exclusive proprietors of the 07000 series of telephone numbers and that the applicants were not entitled to obtain registered rights in a mark incorporating the 07000 number. He therefore concluded that the applicants had made their application in bad faith and that the opponents were successful under Section 3(6).

The claimant was a member of Parliament and an author. The defendant published a column which was said to give the impression that the claimant had written it. It was a parody. The claim was in passing off. Held: The first issue was whether a substantial number of readers had been misled. The deception must be more than momentary and inconsequential. A parody of writing style was capable of constituting the tort of passing off and being a breach of Copyright Act rights even though there was a clear attribution. Here the evidence supported the fact that the parody, which relied upon creating just enough, but not too much confusion, had crossed the line. It was sufficient to establish that one of the possible reasonable meanings of the publication would mislead a substantial number of people; but a single meaning was required for the statutory tort of false attribution of authorship.

Revocation: Request for an award of costs
Summary: The background to these proceedings was that the applicant had refused to purchase marks, which it knew had not been in use, and the registered proprietor had refused to cancel the marks. It had been prepared to sell the marks to the applicant at £250 per mark. The applicant filed applications for revocation which were granted as the registered proprietor did not defend the registrations. The applicants asked for costs on the normal scale but the award was refused by the Hearing Officer on the basis that there had been further scope for negotiation between the parties which could have avoided the need for revocation.
The Appointed Person decided that on the evidence the Hearing Officer had misdirected himself. An impasse had been reached in the negotiations and the only option open to the applicants was to file for revocation. Having been successful in that regard they were entitled to their costs at the rate of £300 per registration. An additional sum of £200 was awarded in respect of the appeal.
Result: Request for an award of costs - Request successful.

(2) that there is a misrepresentation by the defendant (whether or not intentional) leading or likely to lead the public to believe that goods or services offered by the defendant are goods or services of the plaintiff; and
(3) that the plaintiff has suffered to is likely to suffer damage as a result of the erroneous belief engendered by the defendant's misrepresentation."

The plaintiff had contributed a design for a system of classifying and selecting tracks to be played on a radio station. He did so under a consultancy contract. Held: A Joint authorship claim required that the contributor had made some direct contribution to the words appearing in the eventual published item. A contribution of ideas was insufficient. What is essential is a direct responsibility for what actually appears on the paper. The defendant was to be licensed to use the copyright database, but only as was foreseen within the original arrangement. The court set out a classic statement of the law on the position of an original author of copyright works.

Summary: The opponents provided evidence to show extensive use of their marks ROOFMATE, WALLMATE, FLOORMATE, PERIMATE and AGMATE in relation to a range of insulation products, They, therefore, claimed that they had a reputation in the suffix MATE which indicated goods from their Company. The applicants claimed use of their BUILDERS MATE mark but such use was very specific in that it related to the name of their chain of do-it-yourself stores and no use was shown on actual goods. A claim was also made that others used MATE marks within the building supplies industry but use of such marks was not substantiated.
The Hearing Officer accepted that the opponents owned a family of MATE marks and that they had a reputation in relation to that word. He therefore concluded, in relation to insulation goods, that the opponents were successful in their opposition. Application allowed to proceed for other goods claimed. Result: Section 5(2)(b) Opposition successful

ECFI An action brought directly against a decision of the President of the Office for Harmonisation in the Internal Market (Trade Marks and Designs) by a member of a Board of Appeal of the Office on the basis of Article 173 of the Treaty must be dismissed as manifestly inadmissible.
According to the first paragraph of Article 173 of the Treaty, the Community judicature may review the legality of acts adopted jointly by the European Parliament and the Council, of acts of the Council, of the Commission and of the European Central Bank, other than recommendations and opinions, and of acts of the European Parliament intended to produce legal effects vis-a-vis third parties. It follows that acts emanating from Community bodies other than those listed in that provision may not be challenged on the basis of it. The Office for Harmonisation in the Internal Market is not one of the Community institutions listed in Article 4 of the Treaty, nor is it mentioned in the first paragraph of Article 173 of the Treaty.
Moreover, such a decision is not immune from all judicial review, having regard to the remedies provided for by Regulation No 40/94 which are potentially available against it.

The court set out tests of bad faith for applications for the registration of trade marks: "I shall not attempt to define bad faith in this context. Plainly it includes dishonesty and, as I would hold, includes also some dealings which fall short of the standards of acceptable commercial behaviour observed by reasonable and experienced men in the particular area being examined. Parliament has wisely not attempted to explain in detail what is or is not bad faith in this context: how far a dealing must so fall-short in order to amount to bad faith is a matter best left to be adjudged not by some paraphrase by the courts (which leads to the danger of the courts then construing not the Act but the paraphrase) but by reference to the words of the Act and upon a regard to all material surrounding circumstances."

In a complaint of trade mark infringement, and when comparing the mark and sign, a lesser degree of similarity between the marks may be offset by a greater degree of similarity between the goods/services and vice versa.
Europa On a proper construction of Article 4(1)(b) of First Council Directive 89/104 to approximate the laws of the Member States relating to trade marks, the distinctive character of the earlier trade mark, and in particular its reputation, must be taken into account when determining whether the similarity between the goods or services covered by the two trade marks is sufficient to give rise to the likelihood of confusion.
The likelihood of confusion must be appreciated globally, taking into account all factors relevant to the circumstances of the case. That global assessment implies some interdependence between the relevant factors, and in particular a similarity between the trade marks and between the goods and services covered by those marks. Accordingly, a lesser degree of similarity between those goods or services may be offset by a greater degree of similarity between the marks, and vice versa. However, since the more distinctive the earlier mark, the greater the risk of confusion, trade marks with a highly distinctive character, either per se or because of the reputation they possess on the market, enjoy broader protection than marks with less distinctive character.
Accordingly, for the purposes of Article 4(1)(b), registration of a trade mark may have to be refused, despite a lesser degree of similarity between the goods or services covered, where the marks are very similar and the earlier mark, in particular its reputation, is highly distinctive. Even if such an interpretation may make the registration procedure much lengthier, it is, in any event, for reasons of legal certainty and proper administration, necessary to ensure that trade marks whose use could successfully be challenged before the courts are not registered.
For the purposes of applying Article 4(1)(b) of First Directive 89/104 to approximate the laws of the Member States relating to trade marks, even where one trade mark is identical to another with a highly distinctive character, it is still necessary to adduce evidence of similarity between the goods or services covered. In contrast to Article 4(4)(a), which expressly refers to the situation in which the goods or services are not similar, Article 4(1)(b) provides that the likelihood of confusion presupposes that the goods or services covered are identical or similar. In assessing the similarity of the goods or services concerned, all the relevant factors relating to those goods or services themselves should be taken into account. Those factors include, inter alia, their nature, their end users and their method of use and whether they are in competition with each other or are complementary.
There is a likelihood of confusion within the meaning of Article 4(1)(b) of First Directive 89/104 to approximate the laws of the Member States relating to trade marks where the public can be mistaken as to the origin of the goods or services in question. Article 2 of the directive provides that a trade mark must be capable of distinguishing the goods or services of one undertaking from those of other undertakings, while the tenth recital in the preamble to the directive states that the function of the protection conferred by the mark is primarily to guarantee the indication of origin. The essential function of the trade mark is to guarantee the identity of the origin of the marked product to the consumer or end user by enabling him, without any possibility of confusion, to distinguish the product or service from others which have another origin. Furthermore, for the trade mark to be able to fulfil its essential role in the system of undistorted competition which the Treaty seeks to establish, it must offer a guarantee that all the goods or services bearing it have originated under the control of a single undertaking which is responsible for their quality.
Accordingly, there may be a likelihood of confusion within the meaning of Article 4(1)(b) even where the public perception is that the goods or services have different places of production. By contrast, there can be no such likelihood where it does not appear that the public could believe that the goods or services come from the same undertaking or, as the case may be, from economically-linked undertakings.

A court no longer has the discretion as to whether to amend a patent upon application, but must, following European practice, do so when a proper application is made. This is the case despite the clear wording of the English Act. A judge at first instance should be careful to follow a line of cases also at first instance so as to avoid uncertainty: "I do not pretend that I would have regarded the point as at all easy, if it had been virgin territory. It would be wrong to leave this case with the impression that I regard the decisions of the three judges as clearly right or, indeed, as wrong. What I do think is that the arguments that I have been presented with do not justify me in departing from those decisions. I consider that the arguments that have been addressed to me are arguments which should be addressed to the Court of Appeal. For my part, I await their decision with interest. For me, I think the right course must be to follow Laddie J, Pumfrey J and Jacob J. Whether one characterises that course as craven or prudent no doubt depends on whether one is [the defendant] or the [claimant]."

cw Inter Partes Decisions - Trade Marks - Opposition - The opponents filed evidence to say that they had first commenced to use the mark WACKERS from 1993 and goods (a game known as “Pogs”) were sold in the USA through such companies as Walmart during 1994 and 1995. The goods were also exhibited at trade shows from 1993-1995 in Los Angeles, New York and Las Vegas. They also claimed to have been in active negotiations with a marketing company in London and provided samples to that company and a couple of others. The total value of goods provided prior to the relevant date was less than $2000 dollars.
The opponents also filed information from a special investigator who had been requested to investigate the applicants business. A Mrs Dowsett stated that she had contacted a Ms Pearce, a marketing assistant, who told her that Mr Mackay, a director of the applicants, visited many conferences and exhibitions around the world to obtain ideas for children’s toys etc and that he had seen the idea for WACKERS in the USA.
Mr Mackay filed evidence on behalf of the applicants. He stated that he had been employed by Allied Domecq for sixteen years. That company owns the brand name WACKY WAREHOUSE which is used for children’s play areas in public houses. When he formed his own company he worked with the originators of the WACKY WAREHOUSE concept, particularly in the area of developing new toys for such play areas. The name WACKERS was chosen as an apt name for a game consisting of one disc hitting another as it was easily associated with the name WACKY WAREHOUSE. A search had been carried out and the application for registration was filed.
Mr Mackay explained that he had been told about the game ‘Pogs’ by a Mr King, a representative of Big Joe Slammers, an American company.
As regards the investigators report Mr Mackay produced a written contemporaneous record of the conversation between Ms Dowsett and MsPearce and it did not support the allegations made by Ms Dowsett. Additionally he claimed that no-one from his company had visited America prior to 1996 and the name WACKERS was being used in proposals in February and March, 1995.
The Hearing Officer accepted the applicants version of events and concluded that the application had not been filed in bad faith. Opposition thus failed on this ground.
Under Section 5(4)(a) - Passing Off - the Hearing Officer concluded that that ground of opposition must fail because there was no proof that the applicants had any reputation or goodwill in the mark in the UK at the relevant date.

Points Of Interest
1. The applicant for revocation had cast doubt on the authenticity of the invoices and exhibits filed by the registered proprietors. The Hearing Officer concluded that these claims had not been substantiated and he ordered the deletion of paragraph 28 of the applicant’s affidavit.
2. Both parties appealed the Hearing Officer's decision to the Appointed Person. In his decision dated 4 May 2000 (SRIS O/169/00) the Appointed Person had the benefit of additional evidence of use before him and in the circumstances found that the registered proprietor should retain his specification in full.

Summary
The registered proprietor filed evidence which established some modest use during the relevant period and the Hearing Officer concluded that this was sufficient to support a claim to genuine use during the relevant five years period. He, therefore, allowed the registration to remain on the Register with a reduced specification.

As the registered proprietor had initially defended the registration the applicant had been put to the expense of being represented at the hearing. In the circumstances the Hearing Officer awarded costs to the applicant for revocation.

The court awarded £1 per CD produced and not sold, and £5 per CD produced and sold for infringement by pressing CDs of recordings of the claimant artist's performances. The court considered the personal responsibility of the director of the one man company. Ferris J said: "it is necessary to look carefully at the conduct of the individual director and to see whether, if it had not been done as agent in the name and on behalf of the company, it would have made the director a joint tortfeasor. In the case of copyright infringement there is also an additional element in the form of Section 16(2) of the Copyright Designs and Patents Act 1988, under which there is an infringement of copyright not only where a person actually does any of the acts restricted by the copyright but also where a person authorises another to do any of those acts. "

The claimant sought to restrain the defendants from using the name 'Bell Atlantic' so as to cause confusion and a passing of the defendant had registered Internet domain names and sought to register trade marks similar to those of the claimants. The defendant argued that the claimant had last traded in the UK several years before, and that there was therefore no continuing goodwill to protect, and that there was no evidence of confusion or deception. Held: The use of a name so similar was inherently an instrument of fraud and a passing off. Goodwill in a name is not lost merely by ceasing to use it. Here, there was no positive evidence of abandonment of the name. Passing off was established. Whether the mere addition of words to a trade mark remains an infringement depends on whether the added matter renders the sign so different from the registered mark as to distinguish it from the mark. It did not do that in this case. Summary judgment and an injunction granted.
