The pursuer suffered head injuries in a road accident. The parties disagreed as to the extent of disablement resulting and therefore the damages. He had sought training in engineering, but had again been injured, and it was felt to be unsafe for him to return.
Held: The evidence was not entirely satisfactory, but he had suffered some memory and other losses: ‘the pursuer’s memory loss constitutes a severe disability that renders the pursuer virtually unemployable.’
