Tower Hamlets Council (Decision Notice): ICO 30 Jun 2010

ICO The complainant requested information in the form of thirty six questions regarding the operation of the Council in the issuing of parking permits and penalty charge notices. The London Borough of Tower Hamlets responded to the complainant by providing information and specific answers to some of the questions. The Commissioner’s decision is that the Council breached section 1(1)(a) as it did not provide a formal, specific response to all the individual questions. However, he has concluded that on a balance of probabilities the public authority does not hold any further information relevant to the request and has upheld its application of section 12(1) to one request. He also found the Council in breach of section 16(1) and ordered it to provide appropriate advice and assistance.
