The Commissioner’s decision is that Tamworth Borough Council has applied regulation 12(4)(b) of the EIR appropriately. However she considers that Tamworth Borough Council has breached regulations 9 (Advice and assistance) and 11 (Representations and reconsideration) the EIR. The Commissioner does not require Tamworth Borough Council to take any steps as a result of this decision.
