Smith v American Life Insurance Company: EAT 13 Jun 2001

The employee was dismissed but before disciplinary proceedings were concluded. The allegations relating to those proceedings were no longer in issue. The tribunal found that she was entitled to one weeks wages in contract, in lieu of the notice provided under the contract. She contended that the contractual provisions relating to the disciplinary period extended that notice period to the end of the disciplinary proceedings. The EAT found that given the conflict in the contract, the tribunal was obliged to interpret that in favour of the applicant, and so had erred.
