Regina v Robinson (Sean): CACD 14 Feb 2003

The defendant appealed against a sentence of imprisonment. He had driven a power boat dangerously, and whilst he was under the influence of alcohol, and had caused a death. The deceased’s mother said she did not wish him to serve a sentence of imprisonment.
Held: There was no statutory equivalent of driving under the influence of alcohol for driving powerboats on public waterways. Nevertheless, those who behaved in this way on public waterways must face real not suspended sentences. Taking account of the attitude of the deceased’s mother the sentence, which would otherwise have been two years, would be set at eighteen months.
