The defendant had been subject to an appeal by the AG against his lenient sentence. A sentence of two year’s detention had been substituted, and he surrendered to the police station to serve the sentence. The police were unable to find the warrant. Two years’ later he was detained. He now argued that having surrendered to custody, the time had been served.
Held: It could not be said that the mere reporting at the station began the running of the sentence.
