The complainant requested information relating to an opinion poll entitled ‘Public Perceptions of the Executive’. OFMDFM disclosed some of the information requested but withheld other information citing section 43(2) of the Act. The Commissioner’s decision in this case is that the exemption under section 43(2) is not engaged and that the information should be disclosed. The Commissioner has also recorded a number of procedural breaches in relation to OFMDFM’s handling of this request.
