Nursing and Midwifery Council (Decision Notice): ICO 7 Jan 2013

The complainant has requested information relating to the termination of the complainant’s company’s contract with the Nursing and Midwifery Council (NMC). The NMC responded by disclosing information within the scope of the request. The complainant does not consider that the NMC has provided him with all of the information falling within the scope of his request. The NMC has argued that it does not hold any further information. The Commissioner’s decision is that the NMC holds no additional information within the scope of his request, other than that which has been provided to the complainant. However, the Commissioner finds that the NMC breached sections 1 and 10 of the FOIA by not responding to the complainant’s initial request within the statutory time period. The Commissioner requires no further steps to be taken.
