The complainant has requested information from Newry, Mourne and Down District Council (‘the Council’) in relation to the 2016 Firmus Energy Newry City Triathlon and 2016 Borderman Half Distance Triathlon. The Council refused to disclose the requested information, citing section 40(2) of the FOIA as a basis for non-disclosure. The Commissioner’s decision is that the Council has correctly applied section 40(2) of the FOIA to the requested information. The Commissioner requires no steps to be taken.
