The complainant has requested information relating to the ownership of land referred to in the ‘Play Provision in Barton on Sea’ report. New Forest District Council stated that it did not hold the requested information. The Commissioner’s decision is that New Forest District Council: wrongly handled the request under the FOIA and failed to issue a proper refusal notice, breaching regulation 14 of the EIR; correctly confirmed that it does not hold the requested information and, in doing so, complied with regulation 5 of the EIR. The Commissioner does not require the public authority to take any steps.
