The complainant has requested information relating to complaints or compensation claims against a named surgeon and details of the outcome of a review about the named surgeon’s work. The Commissioner’s decision is that Mid Yorkshire NHS Trust (‘the Trust’) has correctly applied section 40(2) of the FOIA to part of the request. He has also determined that the Trust was not obliged to confirm or deny if some of the information was held under section 40(5)(b)(i).The Commissioner does not require the public authority to take any steps.
