Malcolm v Regina: CACD 1 Sep 2011

Appeal from conviction of theft ‘of a quantity of fixtures, fittings and furniture belonging to Warda Ltd’. He did not give evidence. He was subsequently sentenced to 21 months’ imprisonment. He appealed the conviction. The principal ground of appeal it was submitted that the Recorder ‘entered the arena and acted as an advocate and a second prosecutor.’
