The complainant has requested a copy of the legal advice provided to the Local Government Ombudsman by Sandwell Metropolitan Borough Council during the course of an investigation of a complaint made about the Council. The Commissioner’s decision is that the requested information is subject to the exception provided by regulation 12(5)(b) (course of justice) of the EIR. He does not therefore require the Ombudsman to take any steps as a result of this notice. Information Tribunal appeal number EA/2012/0083 dismissed.
