[ Bailii ] Â Commission -v- Italy (Judgment) Times, 21 January 2003; C-14/00; [2003] EUECJ C-14/00; C-14/00 16 Jan 2003 ECJ European, Intellectual Property, Consumer The Italian state created a law which required producers of chocolate containing vegetable fats other than cocoa, to label it as 'chocolate substitute' The Commission challenged the law. The Italians contended that the Directive operated so as fully to state the law relating to the labelling of chocolate. Held: The requirement operated so as to infringe the Treaty. The directive imposed some restrictions on the use on non-cocoa butter fats and on labelling, but was clear in its terms that it was not intended to be a complete harmonisation of the law to replace national rules. In the absence of such complete harmonisation, the Italian law operated to act a brake on marketing such products by denigrating them. Whilst it was proper to ensure that consumers knew what was in what they were eating, but the product was not so different as to justify the requirement. [ Bailii ] Â Sony Music Entertainment (Uk) Limited, Sony Music Entertainment Inc , Polydor Limited, Umg Recordings Inc , Virgin Records Limited -v- Easyinternetcafe Limited Times, 06 February 2003 28 Jan 2003 ChD The Honourable Mr Justice Peter Smith Intellectual Property, Litigation Practice The claimant sought damages from the defendants who ran an internet cafe where its visitors downloaded files from the Internet and then copied the files onto CDs, so infringing copyrights owned by the claimants. Held: The defendants were not paid directly for the copying, but it was part of the charge for the service. Whatever defence might have been available to the private customers under section 70, the intervention for profit by the defendant defeated that defence. Liability for infringement was strict. On a Part 24 hearing, the court should not be told of the existence of a Part 36 offer. The registered proprietors claimed use in respect of a range of goods while admitting that there had been no use in respect of "Life saving and weighing instruments and apparatus". The registered proprietors evidence in support of their claims was somewhat vague and unfocussed and in many instances statements made were not supported by the exhibits and documentation. Having carefully sifted through the evidence the Hearing Officer concluded that the registered proprietors had only shown use in respect of "measuring and signalling apparatus and instruments, all for use in sport" and that the other goods in the registration should be cancelled from the date of filing of the application for revocation (Section 46(1)(b)). Even though Section 46(1)(a) had been quoted as a ground of revocation all the evidence and discussion had been in relation to the five year period prior to the filing of the application. As the registration dated from 1951 the Hearing Officer did not feel able to consider the question of non-use for the five year period following registration. Trade Marks Act 1994 46(1)(a) 46(1)(b) 1 Citers [ Bailii ] Â Omega (Trade Mark: Revocation) (O-028-03) O/028/03; [2003] UKIntelP o02803 30 Jan 2003 IPO Mr D Landau Intellectual Property IPO Section 46(1)(a): - Revocation failed. Section 46(1)(b): - Revocation successful. 1. The Hearing Officer had to decide whether watches made of gold and/or incorporating precious stones were items of jewellery. He decided such watches were not items of jewellery. 2. The registered proprietors appealed to the Appointed Person. Appeal partially allowed in that registered proprietors allowed to retain a slightly wider specification. The registered proprietors registration dated from 1927 and the original specification read "goods of precious metals and jewellery, and imitations of such goods and jewellery". In 1995 the registration was reclassified into Classes 5, 9, 14 and 16 with the Class 14 specification reading as originally filed. The proprietors accepted that there had been no use of their mark in respect of any goods in Classes 5, 9 and 16 and that revocation of the mark in these Classes should follow. However, they wished to retain in full their Class 14 specification. The applicants for revocation had not attacked the Class 14 registration in full since they accepted that the registered proprietors sold watches under the mark OMEGA. They, however, sought revocation of all the other goods. The registered proprietors filed evidence of use of their mark and sought to show that there had also been use on clocks. Their evidence, however, did not show use of the mark OMEGA in relation to such goods. The proprietors also sought to argue that as many of their watches incorporated precious stones and were made of gold, they would be referred to in the context of jewellery. The Hearing Officer did not agree. In his view watches were not jewellery and he therefore reduced the registered proprietors' Class 14 specification to "wrist watches and parts and fittings therefore; all being made of precious metals or imitations of precious metals". Revocation of other goods to be from the date of the application for revocation. [ IPO ] Â Omega (Trade Mark: Revocation) (O-026-03) 474165; 699057; 1456848; [2003] UKIntelP o02603 30 Jan 2003 IPO Mr D Landau Intellectual Property IPO Section 46(1)(a) - Partial revocation action failed Section 46(1)(b) - Partial revocation successful (in part). The above registered mark covered a range of services in Class 37 and included "Maintenance and repair of horological and chronometric instruments" which were excluded from the request for revocation, it being accepted by the applicants that the registered proprietors trade in watches and offer a repair service in relation to such goods. The registered proprietors filed evidence to support a claim that they had used their mark in relation to the full list of registered services. The Hearing Officer examined the evidence carefully and accepted that the registered proprietors' activities in relation to measuring, checking information etc apparatus were in relation to sports and he restricted the specification of the registered mark accordingly. This in turn restricted the coverage of information services which applied to this new restricted area of proved activity. All the evidence filed related to the five year period prior to the filing of the application and the Hearing Officer decided that the revoked goods should be excluded from the date of the application which was 14 September 2001. As both parties had had a measure of success the Hearing Officer decided that both sides should bear their own costs. It was claimed to have come to be used as a general designation of certain kinds of beer. Held: The Philips decision appeared to supercede the Bach Flower case insofar as it looked at the interrelationship of the two subsections 1(1) and 3(1)(a). Those subsections could not be read to create an additional test of distinctivess over and above subsections 3(1)(b) to 3(1)(d). Where a sign is not inherently distinctive, but became so by use, whether it was outside sections 3910(b) to 3(1)(d) remained that of the average consumer (Bach), and if it did pass that test, then it satisfied also 1(1) and 3(1)(a), and was registerable. A trade mark can be distinctive and simultaneously convey a description of the goods. The claimants asserted that the construction of the hull infringed its patent. Held: The Act specifically excluded liability where an infringing ship or other item came into the jurisdiction only accidentally or temporarily. The word 'temporarily' should be construed to mean 'transient' or 'for a limited period of time'. The fact that visits were regular or frequent was to no effect, provided they remained temporary. Counsel "had some difficulty in suggesting just where the line might be drawn. I am not at all surprised. There is no line to be drawn. The matter cannot depend on something as indefinite and imprecise as frequency. Crown Cork and Seal opposed the application on the grounds that Calix had (i) acted in bad faith and had delayed unduly in seeking the amendment; and (ii) the proposed amendments would not in any case cure the defect. On discretion, the applicants argued at the hearing that although they and their patent agent had been aware of the existence of the German application since 1995, they had always proceeded on the basis that the main claim of their EP patent was clearly distinguished from all the prior art that they were aware of. In January 1999 Calix were given a Counsels opinion which indicated that claim 1 of the EP patent as it stood was invalid in view of the disclosure of the German application. At that stage, on their patent agents advice, they sought an opinion from their own Leading Counsel who advised them that it was likely that claim 1 was indeed invalid in view of the German application. Calix immediately applied to amend the EP patent. Referring to the judgement in Instance & anr v CCL Label Inc [2002] FSR 27, the HO concluded that, on the balance of probabilities, there had been no culpable delay on the part of Calix, and that the application should not be refused as a matter of discretion. In determining whether the proposed amendments were such as to cure the defect, the HO found the proposed amended claim 1 novel over the German application. On the question of inventive step, Calix argued that the issue should be considered on the basis the German application alone, and that the HO should not consider the prior art submitted by CCS ( a series of technical abstracts). Following the judgements in Great Lakes Carbon Corporations Patent [1971] RPC 117 and Minister of Agricultures Patent [1990] RPC 61, the HO agreed that he could not allow the proceedings to develop into a roving enquiry into the validity of the EP patent. Having considered the amended claim 1 in light of the German application alone, and what would have been common general knowledge in the packaging industry at the time, the HO found the amended claim to be inventive. The company had traded selling fire extinguishers under the mark Minimax in Benelux countries. They ceased to sell new products but continued to sell spare parts. The mark's registration expired. The complainant sold similarly in Germany under their mark registered there. They challenged the re-registration of the mark, saiying the mark was no longer being used. Held: It was the Community intention that the maintenance of rights in a trade mark be subject to the same condition regarding genuine use in all the Member States. Was the use for the sale of spares only a genuine use? There is `genuine use' of a mark where it is used to guarantee the identity of origin of the goods or services, in order to create or preserve an outlet for those goods or services; but not token use for the sole purpose of preserving the rights conferred by the mark. When assessing whether use of the trade mark is genuine, regard must be had to all the facts and circumstances relevant to establishing whether the commercial exploitation of the mark is real, particularly whether such use is viewed as warranted in the economic sector concerned to maintain or create a share in the market for the goods or services protected by the mark, the nature of those goods or services, the characteristics of the market and the scale and frequency of use of the mark. The fact that a mark is not used for goods newly available on the market but for goods that were sold in the past does not mean that its use is not genuine, if the proprietor makes actual use of the same mark for component parts that are integral to the make-up or structure of such goods, or for goods or services directly connected with the goods previously sold and intended to meet the needs of customers of those goods. The defendant sold goods it had not bought from the claimant, but bearing the mark. The defendant alleged exhaustion of the claimant's rights. Held: The burden of proving exhaustion of rights lay on the defendant, unless he could show that the result would be to create a real risk of the partitioning of the market. If he established that, then the burden of proving that the products had been placed on the market outside the EEAwith his consent so as to disapply article 7(1). The parties disoputed whether the goods were first marketed in the EEA. The importer argued that to disclose its sources would deter its suppliers in the future, thus enabling the proprietor to partition the market in the EEA. The Court of Justice held that Articles 28 and 30EC were applicable so that in such circumstances the proprietor had to show initially that the goods were not first marketed in the EEA with its consent. The opponents' opposition was based on their ownership of registrations in Classes 9, 16, 35, 41 and 42 of their mark CORBIS. The opponents claimed use of their mark in relation to computer readable media from 1994 but only gave turnover figures for the year 2000. No details of sales were provided before the material date of June 2000. Some advertising took place between September 1999 and December 2000. The Hearing Officer accepted that their mark CORBIS was an inherently distinctive mark. The applicants also claimed extensive use of their mark in relation to property protection services with turnover increasing from Â£5.3m in 1996/7 to Â£33.5m in 2000/2001. They claimed that the respective firms operated in totally different trade areas and there was no likelihood of confusion. The Hearing Officer noted the principal activities of the two parties but under Section 5(2)(b) noted that he must compare the respective specifications. Having carefully considered the matter he concluded that at best there was only a slight possibility that similar goods were at issue. As regards the respective marks he considered that ORBIS and CORBIS were not similar and he did not believe that the public would consider that the device element which preceded the word ORBIS would be seen as a letter ‘C' and thus increase the likelihood of confusion. Taking an overall view of the matter he did not consider that the marks in their totality were similar and as there was little of any similarity in the respective goods and services, he considered there was no likelihood of confusion. Opposition failed on this ground. Under Section 5(4)(a) - Passing Off - the Hearing Officer noted that the opponents had filed insufficient evidence to establish that they had a goodwill in their mark. Thus they must also fail in their opposition on this ground. Acquired distinctiveness was a significant issue, and the question of whether the appeal was a review or a rehearing was significant. In this appeal, the parties had given oral evidence, and the Registrar contended that any further appeal to the High court should be by way of review only. The CPR were not excluded, but would provide for a review only. Held: It was insufficient to characterise the decision as administartive. The appointed officer was accepted not to be an independent tribunal. The decision to be made would involve private rights and the right to a fair trial was engaged. The question was whether the court was obliged to order a rehearing rather than a review whenever an ex parte hearing had taken place. It was for the court to decide whether a rehearing was appropriate. The need to comply with Art 6.1 meant that a rehearing had to be available if needed. In this case a review was adequate. The mark sought had to be used, up to the relevant date, as a trade mark. It is otherwise difficult to see how the feature (a clear bin) could come to be regarded in the minds of the public as a guarantee of origin. On that basis the court would have dismissed the appeal on acquired distinctiveness. On attempting to have that judgement enforced, the Chancery court found that the European Court had made a finding of fact contrary to the original court, and had therefore acted in excess of jurisdiction, and had refused to enforce it. Held: The true characterisation of the judgement of the European Court was that it had not depended upon the finding of fact referred to. The issue at the heart of the judgment was whether the registration rights would be affected by use of the mark by a third party. The sale by the defendant of goods bearing the claimant's marks carried the same inference as to origin of those sold by the club. Appeal allowed. The assignor later sought to resile from the assignment. Held: It is standard practice in the music licensing business for a licensee and a licensor to enter into a deal memo followed by a long form contract, but the deal memo's and contract are not of a standard form. The circumstances are not so strong and exceptional as to displace the conventional meaning of the phrase "subject to contract". The burden was on the Defendant to establish any custom or usage within the industry to the effect that "subject to contract" does not bear the meaning it bears in normal legal usage. That burden was not discharged. The fact that a party to an agreement "subject to contract" acts on the faith of that agreement does not raise any estoppel as to the existence of a binding contract. In this case there had been representations and acts in reliance upon those expectations. An estoppel was created, and a contract concluded. There was accordingly no action for copyright infringement. The claimant also sought damages for the derogatory treatment of his work. That was claimable only if his reputation was damaged. The court had the faintly surreal experience of three gentlemen in horsehair wigs examining the meaning of such phrases as "mish mish man" and "shizzle (or sizzle) my nizzle", but there was no evidence of the author's reputation or damage to it. They said the beers produced were of inferior quality, and threatened the brand. The grant of such injunctions created commercial risks for third parties, and it seemed reasonable to require undertakings form the applicant for such an injunction. However a freezing order is of a special type, the existence of which could be doubted. A non-proprietory freezing order did not relate to assest in which the applicant held any interest, but rather created a right. Nevertheless a wide injunction could be a request for a claimant to issue blank cheques to unkown and uncounted third parties. A third party who was adversely affected could himself make application to the court, and a wide undertaking was not required. A cross-undertaking had not been given for the benefit of third parties; but the company argued that, by analogy with the standard practice in freezing order cases, it should have been. Neuberger J: "None the less, while this court should not be over-indulgent to a person seeking an interlocutory injunction, it seems to me that it would be a strong thing to require him to sign not merely a blank cheque in favour of the defendant, if it turned out that he should not have been granted the injunction, but a series of blank cheques in favour of third parties of whose very existence and interest he may be unaware and for whose losses he may find himself liable even though he is entitled to his injunction. As Mr Howe says, if a third party is detrimentally and unfairly affected by an interlocutory injunction, his interest can either be put before the court by the defendant, as happened in Galaxia, or he can himself make an application to the court to vary or discharge the interlocutory injunction or to extend to him the benefit of the cross undertaking. If it could be said that the court was overburdened with such applications by third parties or that there were many cases of injustice to third party because of the absence of such a wide cross undertaking, then there might be more in this point. However, I have not had my attention drawn to any case which has led to a procedural problem, nor any reports, whether in the law reports or legal commentaries, of a perceived injustice in this connection." 47 Accordingly, I am not persuaded that it would be appropriate to impose the sort of wide cross undertaking indemnities on a claimant seeking an interlocutory injunction. That is not to say that the court should never consider imposing a wider cross undertaking in damages than that usually extracted from an applicant for an interlocutory injunction. It is fair to say that the argument in this case has ensured that I will henceforth think a little more carefully about the terms of any cross undertaking in damages to be extracted from a claimant in return for the grant of an interlocutory injunction. 48 Quite apart from this, it seems to me that Miss Heal's contention suffers from a further problem, namely whether the effect of the wider cross undertaking which she seeks can properly be imposed. Held: Registered trade marks, like all other statutory intellectual property rights do not give a right to the proprietor to use, but give him the right to exclude others from using. The owner of the registered trade mark does not have an entitlement to use his mark in the face of earlier competing rights owned by someone else. The judge was wrong to find that Celltech was not precluded from relying on the doctrine of equivalence because of an Amendment Estoppel, but was right to find that Celltech was so precluded by an Argument Estoppel. There were negotiations, following which the defendants wrote claiming damages or licence fees. The claimant asserted that the letter constituted a threat. The defendant argued justification. Held: The court has to determine in all the circumstances not only whether a threat was made but also its extent. The letter was not part of the without prejudice negotiations, but a simple demand. Letters had also been written to potential customers of the plaintiffs. As to the allegation of infringement, the patents were limited in their scope, and the proposed products included elements which made them non-infringing. Held: The discretion given included the power to prevent uses of a mark for similar as well as dissimilar goods where a proprietor had an established reputation in the mark in that class of goods. The infringements referred to in article 5(2) of the Directive, where they occur, are the consequence of a certain degree of similarity between the mark and the sign, by virtue of which the relevant section of the public makes a connection between the sign and the mark, that is to say, establishes a link between them even though it does not confuse them: see, to that effect, General Motors Corpn v Yplon SA (Case C-375/97) [1999] ECR I-5421, 5445- 5446, para 23. The existence of such a link must, just like a likelihood of confusion in the context of article 5(1)(b) of the Directive, be appreciated globally, taking into account all factors relevant to the circumstances of the case: see, in respect of the likelihood of confusion, SABEL, para 22, and Marca Mode, para 40. The answer to question 2(a) must therefore be that the protection conferred by article 5(2) of the Directive is not conditional on a finding of a degree of similarity between the mark with a reputation and the sign such that there exists a likelihood of confusion between them on the part of the relevant section of the public. It is sufficient for the degree of similarity between the mark with a reputation and the sign to have the effect that the relevant section of the public establishes a link between the sign and the mark." Held: There was no trade mark infringement: "With respect to trade marks, it is settled case-law that the specific subject-matter of a trade mark is, in particular, to guarantee to the owner that he has the exclusive right to use that mark for the purpose of putting a product on the market for the first time and thus to protect him against competitors wishing to take unfair advantage of the status and reputation of the trade mark by selling products illegally bearing it. The implementation of such protection is therefore linked to the marketing of the goods. Transit, such as that in issue in the main proceedings, which consists in transporting goods lawfully manufactured in a Member State to a non-member country by passing through one or more Member States, does not involve any marketing of the goods in question and is therefore not liable to infringe the specific subject-matter of the trade mark. Furthermore, as Advocate General Mischo noted at point 45 of his Opinion, that conclusion holds good regardless of the final destination of the goods in transit. The applicants accepted that the opponents had a reputation in their mark. The applicants explained why they had adopted their ALDO’S mark and claimed that it was an Italian Christian name. They claimed that the mark had been put into use, after the date of filing, in relation to microwaveable snack food products and they were not aware of any confusion between the respective marks. Under Section 5(2)(b) the applicants argued that the opponents in their pleadings, which were somewhat unclear, had restricted their opposition to identical goods only. The opponents disputed this and the Hearing Officer decided that as the opposition was under Section 5(2)(b) similar goods must also be considered. In any event it was a fact that in most instances identical goods were at issue. The Hearing Officer then compared the respective marks ALDI and ALDO’S and decided that while there were some similarities it was likely that they would be pronounced as AL-DEE and AL-DOH’S and concluded that they were not so similar as to lead to confusion. Opposition failed on this ground. The opponents also failed on the Section 5(4)(a) ground in view of the Hearing Officer’s finding that the respective marks were not similar. "When a free-lance designer is commissioned to create a logo for a client, the designer will have an uphill task if he wishes to contend that he is free to assign the copyright to a competitor. This is because, in order to give business efficacy to the contract, it will rarely be enough to imply a term that the client shall enjoy a mere licence to use the logo, and nothing more. The Appointed Person considered the totality of the evidence before her and decided that the specification should be slightly wider than that allowed by the Hearing Officer and should read "watches and jewel-watches and parts and fittings therefore, all being made of precious metals or imitations of precious metals".
