(Woolf) "I will accept that the entering into a treaty by the Secretary of State could give rise to a legitimate expectation on which the public in general are entitled to rely. Subject to any indications to the contrary, it could be a representation that the Secretary of State would act in accordance with any obligations which he accepted under the treaty. This legitimate expectation could give rise to a right to relief, as well as additional obligations of fairness, if the Secretary of State, without reason acted inconsistently with the obligations which this country had undertaken." (Hobhouse LJ) "If there was no statement of executive policy other than the executives ratification of a treaty, it might be possible to say that it was legitimate expectation that the executives treatment and decision of matters falling within the ambit of such a treaty would be dealt with in accordance with that treaty." Hobhouse LJ considered the principle of legitimate expectation and said that it is "a principle of fairness in the decision-making process". It is "a wholly objective concept and is not based upon any actual state of knowledge of individual immigrants or would-be immigrants;… however, the application of the principle must be based upon some objectively identifiable legitimate expectation as to how decisions will be made and discretions exercised." 1 Citers [ Bailii ]  Regina -v- Secretary of State for Home Department ex parte Mehmet Kabala [1998] EWCA Civ 728 27 Apr 1998 CA Immigration [ Bailii ]  Regina -v- Secretary of State for Home Department ex parte Hurtado [1998] EWHC Admin 466 29 Apr 1998 Admn Immigration [ Bailii ]  Regina -v- Secretary of State for the Home Department Ex Parte Yiadom Times, 01 May 1998 1 May 1998 CA Immigration, European The decision to exclude an EU national from United Kingdom for the facilitation of illegal immigration was proper, even though the decision was also motivated by a wish to avoid the costs of prosecution and imprisonment for the national purse.  Singh's Application for Judicial Review [1998] EWCA Civ 796 7 May 1998 CA Hobhouse, Waller, Robert Walker LJJ Immigration Renewed application for leave to bring judicial review of refusal of asylum. Held. The appeal was dismissed: "The extent to which statements could found a legitimate expectation depended upon the circumstances in which they were made: whether, reasonably construed, they could be taken as propounding a policy, or were merely statements applicable to particular cases or classes of cases. Regard had to be given to the background against which they were made and, if made against the background of statutory provisions, to the terms of the Act and any relevant rules." 1 Cites 1 Citers [ Bailii ]  Queen -v- Chief Immigration Officer ex parte Ade Wilson Gbadegesin [1998] EWHC Admin 508 8 May 1998 Admn Immigration [ Bailii ]  Regina -v- Immigration Appeal Tribunal ex parte Shamsher Singh [1998] EWHC Admin 521 11 May 1998 Admn Immigration [ Bailii ]  Regina -v- Immigration Appeal Tribunal ex parte Shamsher Singh [1998] EWHC Admin 520 11 May 1998 Admn Immigration [ Bailii ]  Regina -v- Immigration Appeal Tribunal and Secretary of State for Home Department ex parte Khawaja Mahfooz Akhtar [1998] EWHC Admin 530 12 May 1998 Admn Immigration [ Bailii ]  Regina -v- Secretary of State for Home Department ex parte Williams [1998] EWHC Admin 542 14 May 1998 Admn Immigration Immigration Act 1971 14(1) [ Bailii ]  Regina -v- Secretary of State for Home Department ex parte Olumuyiwa Kofi Sosanya [1998] EWHC Admin 551 15 May 1998 Admn Immigration [ Bailii ]  ex Parte Domingos -v- Special Adjudicator [1998] EWHC Admin 546 15 May 1998 Admn Immigration [ Bailii ]  Queen -v- Secretary of State for Home Department ex parte Kusamot A Owolarafe [1998] EWHC Admin 550 15 May 1998 Admn Immigration [ Bailii ]  Regina -v- Immigration Appeal Tribunal ex parte Sergei Boiko and others [1998] EWHC Admin 555 18 May 1998 Admn Immigration [ Bailii ]  Regina -v- Immigration Appeal Tribunal ex parte Elhamit Gunes [1998] EWCA Civ 852 19 May 1998 CA Immigration [ Bailii ]  Regina -v- Immigration Appeal Tribunal ex parte Stephen Osazuwa and Ellivate Osazuwa [1998] EWHC Admin 573 20 May 1998 Admn Immigration [ Bailii ]  Regina -v- Secretary of State for Home Department ex parte Kaya [1998] EWHC Admin 582 21 May 1998 Admn Immigration [ Bailii ]  Regina -v- Secretary of State for Home Department ex parte Kaya [1998] EWHC Admin 581 21 May 1998 Admn Immigration 1 Citers [ Bailii ]  Regina -v- Secretary of State for Home Department ex parte Zafai [1998] EWCA Civ 880 21 May 1998 CA Immigration [ Bailii ]   Regina -v- Secretary of State for Home Department ex parte Abdullah Turgut; Admn 22-May-1998 - [1998] EWHC Admin 592  In ex parte Sosanya, Application for leave [1998] EWHC Admin 585 22 May 1998 Admn Immigration [ Bailii ]  ex parte Sosanya [1998] EWHC Admin 586 22 May 1998 Admn Immigration [ Bailii ]  Regina -v- Secretary of State for Home Department (1st ) an Adjudicator Immigration Appellate Authority (2nd) Immigration Appeal Tribunal (3rd) ex parte Galliston [1998] EWHC Admin 591 22 May 1998 Admn Immigration [ Bailii ]  Regina -v- Special Adjudicator ex parte Thevakumar [1998] EWHC Admin 599 2 Jun 1998 Admn Immigration [ Bailii ]  Regina -v- Secretary of State for Home Department ex parte Mahmood [1998] EWHC Admin 610 5 Jun 1998 Admn Immigration [ Bailii ]  Cruz -v- Maggagna [1998] EWCA Civ 922 8 Jun 1998 CA Immigration [ Bailii ]   Danian (Refugee Sur Place, Sexual Practices, Laws Against, UNHCR Handbook) Nigeria; IAT 9-Jun-1998 - [1998] Imm AR 462; [1998] UKIAT 16494; [1998] INLR 375  Regina -v- Secretary of State for Home Department ex parte Thayaparan Iyadurai [1998] EWCA Civ 959 10 Jun 1998 CA Immigration [ Bailii ]  Tigist Mehari -v- Secretary of Sate for Home Department [1998] EWCA Civ 1005 15 Jun 1998 CA Immigration [ Bailii ]  Regina -v- Secretary of State for the Home Department ex parte Iyadural Times, 16 June 1998 16 Jun 1998 CA Immigration Asylum seeker could not claim that Germany was not a safe third country to be returned to without determination of the asylum claim here.
