Under the existing agreements, having fielded over 50 candidates, they were allocated only five minutes. Held: Neither the inclusion of past electoral support as part of their general criteria for allocating party election broadcasts nor their treatment of the lack of it in this case was irrational. Both the BBC and ITV companies were under a duty to act with due impartiality. The application was dismissed. 1 Cites [ Bailii ] In the Matter of Representation of People Act 1983 and In the Matter of Local Government Election for Aberaman South Ward County Borough of Rhonnda Cynon Taff Held on 23Rd November 1995 [1997] EWCA Civ 1512 24 Apr 1997 CA Elections Representation of People Act 1983 [ Bailii ] Regina v British Broadcasting Corporation and Another Ex Parte Referendum Party Times, 29 April 1997 29 Apr 1997 QBD Elections Previous electoral support is a proper consideration for granting party election broadcasts. He had sought to demonstrate the evils of abortion, and now renewed his application for leave to bring judicial review of the decision. Held: It was not arguable that the respondent's decision was perverse, and the election having passed, no further virtue was to be served by conducting a full review. Each such decision would be on its own merits. 1 Cites 1 Citers [ Bailii ] |
