A testator, in 1614, founded a preachership, a school and almshouses, but neither by the will nor by the Royal charter of foundation was any provision made as to the religious instruction of the scholars ; the latter empowered the governors to make such reaaonable statutes for the “good rule and governance” of the school as they should think proper, so as not to be repugnant to the laws of the realm. Statutes were accordingly made, requiring the scholars to attend church and receive religious instruction. Held. that this was not a Church of England school ; and it was ordered, in a proposed new scheme, that children whose parents objected, should neither be compelled to attend church or to receive religious instruction.

Cockburn CJ said "an occasional omission might suffice" to constitute the offence under the bye-laws of not securing the regular attendance of a child at school, contrasting it with the graver sanction of a school attendance order which might result from an habitual failure.
