Held: Jowitt J said: "[I]t has to be borne in mind that counterfeiting of video films is a serious offence. In effect to make and distribute pirate copies of films is to steal from the true owner of the copyright, the property for which he has to expend money in order to possess it. It is an offence really of dishonesty". Its object was to give general guidance by alerting sentencers to the changed regime of early release and requiring them to have regard to the possible effects of passing sentences after October 1992 of the same length as those they would have passed before. Precise and calculated comparisons are not possible." Criminal Justice Act 1991 1 Cites 1 Citers Regina v Ragusa (1993) 14 Cr App R(S) 118 1993 CACD Macpherson J Criminal Sentencing The victim was a young woman who was tied up in her home and subjected to a variety of indecent assaults including oral sex and she was threatened with a knife. Held: The sentence of 12 years' imprisonment, imposed for false imprisonment, indecent assault and robbery was correct. The questions was posed as to whether, if the maximum of 10 years was an appropriate sentence in relation to the indecent assault, it might have been appropriate to add 2 years for the aggravating feature of the false imprisonment. "The position is that we must look to see whether there was sufficient criminality to pass a sentence of this length, and we must consider whether the overall sentence was appropriate for this appellant and these offences." 1 Citers Regina v Eames [1993] 14 Cr App R (S) 205 1993 CACD Criminal Sentencing 1 Citers Regina v Hadley (1993) 16 Cr App R(S) 358 1993 CACD Criminal Sentencing 1 Citers Cronin v Her Majesty's Advocate 1993 SCCR 158 1993 Criminal Sentencing The imposition of a discretionary life sentence is an exceptional disposal justified only where the accused presents a serious threat to the safety of the public or where that sentence is in his own best interests. 1 Citers Practice Direction On Imposition of Discretionary Life Sentences Gazette, 10 March 1993 10 Mar 1993 LCJ Criminal Sentencing Practice Direction by Lord Chief Justice on how judges should use discretionary life sentences.
