Kings Lynn and West Norfolk Borough Council (Local Government): ICO 6 May 2022

The complainant has requested information associated with a planning application. Borough Council of King’s Lynn and West Norfolk (‘the Council’) released information with personal data redacted. The complainant considers that the Council holds further, relevant information. The Commissioner’s decision is as follows: On the balance of probabilities the Council disclosed all the relevant and non-exempt information that it holds and has complied with regulation 5(1) of the EIR. The Council was in breach of regulation 5(2) and regulation 14(2) however, as it did not disclose the information or issue a refusal within 20 working days of the request. The Council was also in breach of regulation 11(4) of the EIR as it did not provide an internal review within 40 working days of the request for one. The Commissioner does not require the Council to take any corrective steps.
