The complainant requested a draft report produced for Invest Northern Ireland which related to the Emerging Business Trust and EBT Venture Fund. Invest NI refused to supply the information, stating that it was exempt under sections 36, 41 and 42 of the Act. The Commissioner has found that Invest NI had correctly applied the exemption under section 41, and that the information requested was exempt from release. However, the Commissioner found that the refusal notice issued by Invest NI was inadequate under section 17. As it was decided the information was exempt under section 41 the Commissioner did not assess whether Invest NI had correctly applied sections 36 and 42.
