The complainant has requested information relating to certain comments that were included in correspondence sent by Hastings Borough Council (the council) to the Local Government Ombudsman (the LGO). The complainant has confirmed that he has now received the information that he required. However, the Commissioner has found that the council has breached regulation 5(2) of the EIR as it failed to provide any information in response to the complainant’s request within 20 working days. In addition, the council also breached regulation 11(4) as it failed to provide its internal review response within the required 40 working days. The Commissioner does not require the council to take any steps as a result of this decision notice.
