The Commissioner’s decision is that the Forestry Commission has failed to demonstrate why Regulation 12(4)(b) of the EIR is engaged and is therefore not entitled to rely on the exception. The Commissioner requires the Forestry Commissioner to take the following steps to ensure compliance with the legislation: issue a fresh response, to the request, which does not rely on Regulation 12(4)(b) of the EIR.
