The complainant has requested correspondence between the council and a developer regarding pre planning advice which was requested. The council has applied Regulation 12(5)(f) to the information. The Commissioner’s decision is that the council correctly applied the exception in Regulation 12(5)(f). His decision is also that the public interest in exception being maintained does outweigh the public interest in the information being disclosed. The Commissioner does not require the council to take any steps.
