Devon County Council (Decision Notice): ICO 16 Mar 2011

The complainant made a request to the Council for information about a particular pedestrian bridge. The Council refused the request on the grounds that it considered the request to be vexatious under section 14(1) of the Act. It maintained its position following an internal review. The Commissioner concluded that the Council appropriately applied section 14(1) of the Act. However, the Commissioner found that by failing to inform the complainant that it was relying upon section 14(1) within 20 working days of receiving the request the Council breached section 17(5) of the Act. He requires no remedial steps to be taken. Information Tribunal appeal EA/2011/0079 allowed.
