Department of Culture Arts and Leisure (Decision Notice): ICO 5 Oct 2006

The complainant requested a report regarding the conduct of the Chief Executive of Waterways Ireland, including the investigation of allegations made by the complainant. The department responded by providing the complainant’s personal data but exempting the rest of the report under sections 27 (international relations), 36 (prejudice to the conduct of public affairs), 41 (confidence) and 40 (personal data). The Commissioner has decided that information was wrongly withheld, but as it has now been provided to the complainant no steps are specified. The department also breached s.17 by not providing an adequate refusal notice. The Information Tribunal has ruled on this decision and has upheld this appeal.
